Abstract
This presentation continues the discussion of an Unprotected Category of Speech: Speech that Advocates Illegal Action. Remember, generally, government may not regulate the Content of Pure Speech UNLESS government meets the most exacting level of scrutiny or strict scrutiny. However, government may (if it chooses to) more freely regulate the Content of Pure Speech if the speech is in an UNPROTECTED category. If the speech is in an unprotected category, government may regulate it generally with a low level rational basis. This presentation continues the coverage of the unprotected category of "Speech that Advocates Illegal Action." The prior video presentations discussed the historical tests/cases and, then, the modern day test-Brandenburg case. This presentation will discuss a post 9/11 case about speech regarding a government designated foreign terrorism group; and, this presentation will question the possible implications of this case for domestic terrorism. This YouTube Channel is designed to provide my students supplemental instruction, as I teach them remotely. I want them to "take a soak" in the law and not a quick shower. This Channel is also designed to provide learning to the broader community. Learning can lead to enlightenment, and enlightenment to justice...or, at least, to a taste of justice.
